By accessing and using Kaley's services at kaley.me (“the Service”), provided by Kaley (“Kaley”, “we”, “us”), you agree to comply with and be bound by these terms and conditions. If you do not agree to these terms, please do not use the Service.

2. Changes to Terms

Kaley reserves the right to change, modify, or revise these terms and conditions at any time. Your continued use of the Service following the posting of any changes constitutes your acceptance of those changes.

3. Registration and Account Security

To access the Service, you must create an account. You agree to provide accurate, up-to-date, and complete information during registration and to keep this information current and accurate at all times.

4. User Conduct

You agree not to use the Service to:

  1. Violate any applicable laws or regulations.

  2. Infringe on any third-party rights, including copyrights, trademarks, privacy, or other personal or proprietary rights.

Acceptable Use Policy (AUP)

  1. Ethical and Responsible Use

All users of Kaley must adhere to our Acceptable Use Policy (AUP), ensuring ethical and responsible behavior.

  1. API Providers and Foundational LLM Models

Our services are powered by foundational Large Language Models (LLMs), provided by partners like OpenAI, Claude, and Google (PaLM). Users must:

  • Avoid using LLMs to create misleading information, deepfakes, or any harmful content.

  • Not use LLMs to promote hate, discrimination, or violence.

  • Follow the additional terms and policies set by our API providers.

  • Ensure that any data or content used with LLMs complies with privacy laws, intellectual property rights, and other legal standards.

  1. Violations and Mitigations

User Notifications: If users are found to be violating the AUP, they will be notified and given the opportunity to address the issue or file an appeal if they believe the determination is incorrect.

Suspension & Termination: Depending on the severity of the violation, Kaley may temporarily suspend or permanently terminate the user's account.

Feedback System: We encourage the community to report any misuse or violations of our AUP.

Continuous Review: Our AUP is regularly updated to reflect societal standards and feedback from our users, ensuring it remains relevant and robust.

By using Kaley, you acknowledge that you have read, understood, and agreed to our AUP. Non-compliance may result in corrective actions as detailed above.

Data Protection and Privacy

  1. GDPR (General Data Protection Regulation) Compliance

For users in the European Union (EU) and European Economic Area (EEA):

  • You have the right to access, correct, or delete your personal data.

  • You can object to the processing of your data, ask us to restrict processing, or request data portability.

  • You can withdraw your consent for data processing at any time.

  • You have the right to file a complaint with a data protection authority about our use of your personal data.

Users retain ownership of the intellectual content they create using Kaley. However, by using the Service, users grant Kaley a non-exclusive, transferable, sub-licensable, royalty-free, global license to use, store, display, reproduce, modify, create derivative works, and distribute the content solely for the purpose of operating and improving the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Kaley is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether directly or indirectly incurred. This includes loss of data, use, goodwill, or other intangible losses arising from (a) your use of or inability to use the Service; (b) unauthorized access to or alteration of your transmissions or content; (c) any other issue related to the Service.

9. Termination

Kaley reserves the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe your actions violate these terms, are harmful to other users, or could damage Kaley's reputation.

10. Governing Law

These terms and any disputes or claims arising from or related to them are governed by the laws of the Hong Kong Special Administrative Region.
